Phase 3: Assessment


To the extent that this has not already been discussed during the intake, the mediator will outline and explain the key aspects of mediation and the mediation agreement (confidentiality, voluntariness, non-committal approach, fees, representation and empowerment). In this phase, both parties further share their side of the story. The mediator guides the parties and promotes constructive dialogue during the discussions. The mediator encourages parties to listen carefully to each other so that their respective (conflicting) interests, views, concerns and wishes are made clear.
